Terms of service
Last updated October 8, 2026
These terms are the agreement between TimetableOS ("we", "us", "our") and the studio, business or person ("you") that uses TimetableOS, including our website, mobile apps, and the studio pages and member portals we host. By creating an account, downloading an app or using the service you accept them. If you accept on behalf of a business, you confirm you have authority to bind it. Customers of a studio who sign up on a studio's page or in its app also accept the parts that apply to them, marked below.
Please read the "Disputes and arbitration" section: it requires most claims to be resolved by individual arbitration, not in court, and waives class actions.
The service
TimetableOS is hosted software for scheduling, memberships, billing, check-in, retail, marketing, payroll and reporting, with a public booking site for each studio and a portal and mobile app for its members. We may improve, change or retire features, and will give reasonable notice of changes that remove something you rely on.
Your account
- You must be at least 18, or the age of majority where you live, to hold an account. Children may be registered as members by a parent or guardian.
- Give accurate information and keep your sign-in details secret. You are responsible for what is done through your account and for the people you invite, including their permissions.
- Tell us promptly if you think an account has been used without permission.
Acceptable use
You will not use the service to break the law, to send spam or messages people have not agreed to receive, to infringe others' rights, to upload malicious code, to probe or disrupt the service, to scrape it, or to resell it without our written agreement. We may suspend an account that does.
Your data and your members
- You own the data you put into the service. You give us a license to host, copy and process it to provide and support the service.
- For your members' personal information, you are the "business" or "controller" and we are your "service provider" or "processor". You are responsible for the lawful collection and use of that information, for telling your members how you use it, for the content of your waivers, forms, terms and messages, and for any consent you need to send marketing. If you collect health information from members, you are responsible for doing so lawfully, including any notices and consents your state requires. Our privacy policy explains how we handle data.
- You can export your data while your account is active. After it closes, we keep it for a limited period and then delete it, as the privacy policy describes. You can also ask us to delete an account at any time.
Payments, subscriptions and renewals
- Payments from your members are handled by a third-party payment processor. You will need to set up an account with it and accept its terms. We do not hold your funds, and we are not responsible for the processor's delays, holds or decisions.
- You are responsible for your prices, sales tax, refunds, chargebacks and disputes with your members, and for complying with consumer law, including the cancellation and automatic-renewal rules that apply to the memberships you sell, such as clear disclosure of recurring charges, consent, and an easy way to cancel.
- Fees for using TimetableOS, and any fee taken from payments, are those shown to you when you sign up or agreed with us in writing. Unless stated otherwise they are charged in advance, are non-refundable, and exclude taxes. A paid plan renews automatically for the same period until you cancel; you can cancel at any time from your account settings or by writing to us, and the cancellation takes effect at the end of the period you have paid for. We will give at least 30 days' notice before changing fees.
Text and email messages
Where you use the service to send email, text or push messages, you confirm that you may send them: that you have each recipient's prior express written consent where the law requires it for marketing texts (including under the Telephone Consumer Protection Act), that each marketing email includes the unsubscribe link and your physical postal address as the CAN-SPAM Act requires, and that you will honor opt-outs promptly, including replies of STOP. Message and data rates may apply to recipients. Carriers and providers may block or delay messages, and we do not guarantee delivery.
If you are a studio's customer
When you sign up, book, buy or sign a form on a studio's page or app, your contract for classes, memberships, gift cards and anything else you buy is with the studio, not with us. The studio's own terms, prices and cancellation rules apply. We provide the software the studio uses, and we are not responsible for the studio's services, safety, or how it treats you. Your account on a studio's page or app is for your own use. If something goes wrong with a booking, payment or membership, contact the studio first.
Health and fitness
TimetableOS and its apps are not medical devices and do not give medical advice. Measurements, goals and information from Apple Health or Health Connect are shown for your own information and to share with a coach you choose, and may not be accurate. Talk to a doctor before starting any exercise or nutrition program. Exercise carries a risk of injury; the risks of any class or session are between you and the studio that provides it.
Mobile apps
You may use our mobile apps on devices you own or control, and subject to the terms of the app store you downloaded them from. Apple Inc. and Google LLC are not parties to these terms, are not responsible for the apps or any claims about them, and have no obligation to provide maintenance or support. Apple is a third-party beneficiary of these terms as they apply to the iOS app and may enforce them against you.
Our property
We own the service, its software, design and brand. We give you a limited, non-exclusive, non-transferable, revocable license to use it for your business while these terms apply. Feedback you give us may be used freely to improve the service.
Availability and support
We work to keep the service available and secure, but it is provided as is and as available, and we do not promise that it will be uninterrupted or error free. Keep your own copies of anything you cannot afford to lose.
Disclaimer of warranties
TO THE FULLEST EXTENT THE LAW ALLOWS, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", AND WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. SOME STATES DO NOT ALLOW THESE DISCLAIMERS, SO THEY MAY NOT APPLY TO YOU.
Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFIT, REVENUE, GOODWILL OR DATA, AND OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE FEES YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE (OR $100 IF YOU PAID NOTHING). We are not responsible for injuries or incidents at your studio, which you run and insure. Nothing in these terms limits liability that cannot be limited by law, such as for fraud or willful misconduct.
Indemnity
You will defend and cover our reasonable costs of any claim brought by a third party, including a member or a regulator, that arises from your use of the service in breach of these terms or the law, or from the content you provide.
Disputes and arbitration
- Talk to us first. Before starting a claim, write to us with a description of the dispute and give us 30 days to resolve it.
- Binding arbitration. If it is not resolved, any dispute between you and us arising out of or relating to these terms or the service will be resolved by binding arbitration administered by the American Arbitration Association under its rules, and not in court, except that either of us may bring an individual claim in small-claims court, and either of us may seek an injunction in court to protect intellectual property or confidential information. The Federal Arbitration Act governs this section. The arbitrator's award may be entered in any court with jurisdiction.
- No class actions. Claims may be brought only in your individual capacity, and not as a plaintiff or class member in any class, collective or representative action. The arbitrator may not combine claims or preside over a class proceeding.
- You can opt out. You may opt out of arbitration and the class waiver by writing to us within 30 days of first accepting these terms, stating that you opt out.
- Courts. If this section is found unenforceable, or you opt out, the claim will be heard in the state or federal courts located where we are headquartered, and you consent to their jurisdiction.
Governing law
These terms are governed by the laws of the state in which TimetableOS is headquartered, without regard to its conflict-of-law rules, and by U.S. federal law where it applies.
Ending the agreement
You can stop using the service and close your account at any time. We may suspend or end your access if you breach these terms, if you do not pay, or if we must by law, and we will tell you why where we can. Sections that by their nature should continue, such as those on liability, data, payment and disputes, continue after the agreement ends.
Changes to these terms
We may update these terms. We will change the date above and, for significant changes, tell account holders by email at least 30 days before they take effect. If you keep using the service after a change takes effect, you accept it.
General
These terms, with the privacy policy and any order form, are the whole agreement between us. If a part is found unenforceable, the rest stays in force. You may not transfer your rights without our consent; we may transfer ours as part of a sale of our business. Our failure to enforce a term is not a waiver. Nothing here makes you our partner, agent or employee. We are not liable for failure caused by events beyond our reasonable control.
